We run our business much in the same way as we make our coffee, with honesty and transparency.

This is how we work:

All references to “Terbodore”, “we”, “us” and “our” in these terms and conditions will refer to Terbodore Coffee Roasters (Pty) Ltd, Registration Number 2016/309056/07, VAT No 4570255069, a limited liability private company operating in the Republic of South Africa. All references to “you” and “your” will refer to any user and/or visitor of www.terbodore.com (“Website”).

These Terms and Conditions manage your use of our website, www.terbodore.com and any and all business transactions/activity that originate from this website and govern all future business dealings between us unless otherwise stipulated (e.g. unless another agreement is signed). By accessing the Site, you agree to be bound by these Terms and Conditions set out in this legal guideline. You may not access, display, use, download, and/or otherwise copy or distribute Content obtained on this website for any purpose without our consent.

Electronic Communications

By using this Website or communicating with us electronically, you consent to and acknowledge that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be in writing.

E-Commerce & Privacy

This Website sells fine coffee and a selection of coffee accessories online. The use of any product bought from this Website is at the purchaser’s risk. We take no responsibility for any loss, injury or damages which may be experienced as a result of using the products sold on this Website and you hereby indemnify us for such loss, injury and/or damage that may be incurred by yourself.

The private information we require to process online orders placed through our e-commerce facility, namely your personal information and credit card details, delivery address and telephone numbers will be kept strictly confidential by us, and not sold or made to be known to third parties. Only information required to deliver the product, such as the delivery address and your contact phone number will be made known to third parties in the delivery process.

We take all the necessary precautions to secure credit card processing to receive payment for the goods we sell. We cannot be held responsible for security breaches you may experience on your personal computer or other electronic devices used to browse the Website, which may result due to the lack of adequate virus protection software or spyware that you may have inadvertently installed.

Cookies

These aren’t the homemade coffee bean cookies we sell at our roasteries. These cookies are small pieces of data sent from a website and stored in your web browser. Each cookie is unique to your web browser, and contains completely anonymous information such as a unique identifier and the website name. This allows a website to remember things like your personal preferences, which products you prefer or what’s in your shopping basket.

Why do we use cookies?

Our Website utilises first and third party cookies. This enables us to:
a) Improve your experience on our Website through various means such as storing preferences (like keeping you logged in) or determining aggregate usage behaviour (time on site, number of pages viewed etc.) through web analytics tools like Google Analytics.
b) Provide more relevant Display Advertising to those who have visit the Website, using third party tools such as the Google Analytics Remarketing.

1) Modify, add or withdraw the website (or any part of it) with or without notice to you. You acknowledge we shall not be liable to you or any third party for any modification to or withdrawal of the website.
2) Change these conditions. Your continued use of the website (or any part of it) following such change shall be considered to be your acceptance of the change. The responsibility lies with you to check the Terms and Conditions regularly to determine whether you agree with them.

We provide certain information on our Website, the content currently or anticipated to be displayed on our Website is provided by us, our affiliates and/or subsidiary, or any other third party owners of such content, and includes but is not limited to Literary Works, Musical Works, Artistic Works, Sound Recordings, Cinematograph Films, Sound and Television Broadcasts, Program-Carrying Signals, Published Editions and Computer Programs (“the Content”). We reserve the right to make any changes to the Website, the Content, or to products and/or services offered through the Website at any time and without notice. All rights to the Content are reserved and retained by the Owners, except as specified in these Terms and Conditions. You are not granted license to any intellectual property including without limitation rights to Copyrights, Trademarks, Patents or any other Intellectual Property of the Content.

Limited License to General Users

We grant you, subject to the further conditions of these Terms and Conditions, a non-exclusive, non-transferable, limited and revocable right to access, display, use, download and otherwise copy the current and future Content for personal, non-commercial and information purposes only.

This Website and its Content may not be reproduced, duplicated, copied, resold, or otherwise exploited for any commercial purpose without the expressed prior written consent of Terbodore Coffee Roasters (Pty) Ltd.

This license does not allow you to collect product or service listings, descriptions or any information displayed here, furthermore it does not allow for any derivative use of this Website or its content for the benefit of another merchant. As a user of this website you may not frame nor use framing technologies to enclose our Website or its’ Content, or any part thereof without our expressed written consent. We do not offer products or services to minors. If you are under the age of 18, you may not respond to or otherwise accept, or act upon any offers on this Website.

Terbodore, our affiliates or subsidiary, reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion. Any unauthorized use terminates this license.

Limitation of liability

The Website and all Content on the Website, including any current or future product offers, are provided on an “as is” basis, and may include inaccuracies or typographical errors. We make no promises or warranties as to the availability, accuracy or completeness of the Content. Neither Terbodore, our affiliates or subsidiary, will be held responsible for any direct or indirect damage of any kind suffered or incurred, related to the use of, or the inability to access the Content or the Website or any functionality thereof, or of any linked website, even if Terbodore is specifically advised thereof.

Privacy: Casual Surfing

You may visit the Website without providing any personal information if you wish. The Website servers will in these instances collect the IP address of your computer, but not your email address or any other distinguishing information. This information is aggregated to measure the number of visits, average time spent on the Website, pages viewed, etc. We use this information to determine why you use the Website, and to improve its content for you. We assume no obligation to protect this information, and may copy, distribute or otherwise use this information without limitation. Choice of Law

This Website is controlled, operated and administered by Terbodore from our headquarters in the Republic of South Africa. Access to the Website from territories or countries where the content or purchase of the products sold on the Website is illegal is prohibited. You may not use this Website in violation of South African export laws and regulations. If you access this Website from locations outside of South Africa, you accept the responsible to comply with all local laws. These Terms and Conditions shall be governed by the laws of the Republic of South Africa, and thus you consent to the jurisdiction of the Cape Town High Court in the event of any dispute. If any provisions of these Terms and Conditions are found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be enforced to the maximum degree permitted so as to enforce the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue on in full effect. These Terms and Conditions constitute the entire agreement between Terbodore and its Website users with regard to the use of its’ Content and their Website.

Terms and Conditions of Sales

When making a purchase with us legal obligations arise and your right to a refund charged to your credit card or paid in any other way agreed by us, are limited by our Terms and Conditions.

Once payment is made, it is deemed that you have read and understood the Terms and Conditions for such purchase so don’t make a purchase through this site unless you understand and agree to all the Terms and Conditions. Payment Options and Pricing

All of our transactions are processed in South African Rands (ZAR). We strive to offer competitive prices on the full range of Terbodore products. The total order price will include the price of your purchase plus any applicable sales tax (VAT) and shipping charges (on the day of shipping).

We reserve the right to change pricing at any time without prior notice. Should prices be reduced on any shipped products within 10 working days of shipment, you may contact us and request a refund of the difference between the price you were charged and the reduced selling price. To be eligible for the refund you must contact us within 14 days of shipment.

Payment Options

Payment may be made via Visa, MasterCard or by bank transfer into The Provider’s bank account, the details of which will be provided after checkout.

Credit card acquiring and security

Credit card transactions will be acquired by Terbodore Coffee via approved payment gateways. Our payment gateways use the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website.

Customer details separate from card details

We take your online security seriously and your Customer details will be stored by us separately from your card details.

Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).

Delivery policy

All our coffee is recently roasted and then shipped straight to you as soon as possible for maximum freshness.

Order Processing

Your coffee order will be hand roasted and dispatched once payment is validated/received (for EFT’s this means that we cannot process the order until the funds have cleared in our account, which is usually the next business day). Should stock be available, orders will be dispatched the same day that payment is validated/received.
Should a product be unavailable for any reason, we will contact you directly with a delivery time estimate. In the event of unforeseen circumstances which may cause delays we will contact you directly with a revised delivery schedule.

Local Shipping

For orders within major cities in South Africa we use a courier service. Please allow two-five working days from receipt of payment to receive your order. Please ensure the correct shipping address is provided from the outset as ownership and risk will pass to you once the order has left our premises.

  • Flat Rate (main cities in South Africa) – R99
  • For areas not serviced by our courier company, The Provider will deliver via Post Office, or to the nearest town to the User that is accessible by our courier company within their normal routes. In these circumstances the Provider will be in contact with the User to arrange an alternative address.

Undelivered Packages

In the case of a package not finding its way to you and being returned to us, we will make every attempt to contact you to arrange for re-shipment. You will be united with your Terbodore delights, we promise. Should the package remain undelivered or uncollected for a period of 30 days, your package will be sold to defray expenses and your payment forfeited and it will be assumed that you have abandoned your goods.

International Shipping

We love for our coffee to travel as far afield as possible. We ship to many countries. If your country is not on the list then please contact us directly at [email protected] or +27 (0)21 876 4716, so we can discuss if it’s possible.

Cancelling orders

If you change your mind (errr… but why on earth would you?) you are entitled to cancel any sale concluded on this Website within 7 days after date of receipt of the goods. In such an event:

  • the full value of the purchase price less shipping costs will be refunded to you within 30 days of you notifying us via email to [email protected] of your intent to cancel
  • you undertake not to open or use the Goods
  • you will have to bear the shipping cost of returning the goods to us

If your order delivery is delayed for more than 7 days from the stipulated delivery date (or where none is specified, beyond 30 days from the order date) you are also entitled to cancel your order. Please read the Return Policy for further details. All of this will be subject to us actually receiving the goods (unopened, not damaged and in good order) within the allotted time frame.

Returns / Refund Policy

We hope that each order brings you a sense of the joy it was produce with, but we are not machines, and no matter how hard we try, mistakes can happen. So if on receiving your order you find you’re your goods are damaged, or the product supplied is not the same as what was ordered, we will gladly provide you with a replacement or refund as long as you return the goods to us unopened and unused in their original packaging.

Damaged goods

  • Please email us at [email protected] from the email address used to make the purchase within 7 days
  • When the product is received in a damaged condition from our couriers it should be clearly noted on the POD (“Proof of Delivery”).

Incorrect goods

  • Please email us at [email protected] from the email address used to make the purchase within 7 days.

If the Goods have been approved for return we will notify you and either arrange for our couriers to collect the item from you OR request that you post it back to us OR ask you to return the item to our roastery location (dependent on the individual circumstances and original order’s shipping method) within 14 days.

Should you need to post the Goods to us please be sure to use our postal address (available above under ‘Contact Information’) and please package the goods carefully so that they do not become damaged en route. Please include a copy of your original invoice with any return.
Once your returned product has been received at our roastery we will endeavour to make sure your refund is back in your account within 7 days.

What happens if the product I have bought is faulty?

If within 6 months of purchase, you have used a product and found it to be faulty, we will collect the product at our expense and either replace, refund or repair the item, depending on the circumstance. To initiate this process you will need to contact us on [email protected] to explain the issue. We will do our best to action your query as quickly as possible. Some products have longer warranties than others. These warranties are usually listed on the product page of each relevant product.

Responsibility

You take responsibility for all aspects relating to the transaction performed on this site. This includes the sale of goods and services, customer service and support, dispute resolution and delivery of goods.
